Last updated 27 June 2025
1. Acceptance of terms
By creating an account or using createwebsite.ng (“the platform”), you agree to these Terms of Service. If you do not agree, do not use the platform. These terms form a binding agreement between you and createwebsite.ng.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a contract to use the platform. By using the platform you confirm you meet these requirements.
3. Your account
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.
4. Plans and payments
- Paid plans are billed in advance on a monthly or annual cycle, as shown at checkout.
- All fees are charged in Nigerian Naira (₦) and are non-refundable unless otherwise stated or required by law.
- Failure to pay may result in suspension or downgrading of your account.
- We reserve the right to change pricing with 30 days' notice to existing subscribers.
5. Acceptable use
You agree not to use the platform to:
- Publish or distribute illegal, harmful, or defamatory content.
- Sell counterfeit goods, illegal products, or services prohibited by Nigerian law.
- Send unsolicited communications (spam).
- Attempt to gain unauthorised access to any system or another user's account.
- Reverse-engineer, copy, or resell the platform or its underlying code.
- Engage in any activity that disrupts or damages the platform or its users.
We may suspend or terminate accounts that violate this policy without prior notice.
5a. Email newsletters
If you send newsletters to your site's subscribers through the platform:
- Email only people who signed up through your site. Bought, rented or imported lists are not allowed.
- Don't use misleading subject lines or sender names, and don't send illegal or harmful content.
- You are the controller of your subscribers' data. You are responsible for having a lawful basis to email them and for answering their requests (for example, to see or delete their data).
- We process subscriber data on your behalf and only to provide the service: we keep it confidential and secure, use our email delivery provider (which may process data outside Nigeria) to send your emails, tell you without undue delay about any breach affecting it, help you answer subscribers' requests, and delete it when your account is closed.
- We may limit, pause or stop your sending, and stop emailing addresses that bounce or complain, if bounce or complaint rates are high or these rules are broken.
6. Your content
You retain ownership of all content you upload to the platform (text, images, product data, etc.). By uploading content, you grant createwebsite.ng a non-exclusive, royalty-free licence to host, display, and deliver that content as part of providing the service. We do not claim ownership of your content and will not use it for any purpose beyond operating the platform.
7. Intellectual property
The platform, its design, templates, and underlying software are owned by or licensed to createwebsite.ng. You may not copy, modify, distribute, or create derivative works without our written permission.
8. Uptime and availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages, or circumstances beyond our control may cause temporary unavailability. We are not liable for losses resulting from downtime.
9. Limitation of liability
To the maximum extent permitted by law, createwebsite.ng is not liable for indirect, incidental, consequential, or punitive damages arising from your use of the platform. Our total liability in any matter is limited to the fees you paid in the 3 months preceding the claim.
10. Termination
You may close your account at any time from the Settings page. We may suspend or terminate your account if you breach these terms, with or without notice depending on the severity of the breach. On termination, your data is deleted as described in our Privacy Policy.
11. Governing law
These terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from these terms shall be subject to the exclusive jurisdiction of the courts of Nigeria.
12. Changes to these terms
We may update these terms from time to time. We will give you at least 14 days' notice of material changes. Continued use of the platform after the effective date constitutes acceptance.
